How we collect, use, disclose, store and protect your personal and credit information.

1. Who we are

This privacy policy is issued by Australian Garment Company Pty Ltd (ABN 50 661 330 981, ACN 661 330 981), trading as Discover Capital Group ("Discover Capital", "we", "us", "our"). Discover Capital is a Credit Representative (No. 554486) of Connective Credit Services Pty Ltd, Australian Credit Licence No. 389328, and is registered with AUSTRAC (Account No. 260365003).

We are bound by the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), Part IIIA of the Privacy Act, the Privacy (Credit Reporting) Code 2014 (v2.3) (the CR Code), the National Consumer Credit Protection Act 2009 (Cth), the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the Notifiable Data Breaches scheme.

2. What information we collect

We collect personal information reasonably necessary for us to assess, arrange, settle and manage credit and financial products, including:

  • Identity information — name, date of birth, residential address, drivers licence or passport details, tax file number where lawfully required.
  • Contact information — email, telephone, correspondence.
  • Financial and credit information — income, employment, assets, liabilities, bank statements, credit history, repayment history, defaults, court judgments and insolvency information.
  • Security and transaction information — details of the property or asset offered as security, loan purpose, deal shape, LVR and settlement details.
  • Sensitive information — only where you have consented and it is necessary for our services.
  • Website and technical information — IP address, device, browser, pages visited, cookies and analytics events.

3. How we collect it

We collect personal information directly from you when you submit an enquiry, deal or scenario, book a call, complete an application, email or call us, or interact with our website. We also collect information from third parties including credit reporting bodies, brokers introducing your deal, your accountant or solicitor, valuers, insurers, referrers, funders and publicly available sources.

4. Why we collect it

We collect, hold, use and disclose personal information to:

  • Assess, arrange, settle, manage and enforce credit and financial products.
  • Verify your identity and meet our AML/CTF, KYC and sanctions-screening obligations.
  • Communicate with you about your enquiry, application or facility.
  • Comply with laws, regulator requests, court orders and industry codes.
  • Improve, secure and personalise our services and website.
  • Send you information about products or services we think may be of interest (where you have not opted out).

If you do not provide the information we request, we may be unable to assess your application, arrange the credit or continue to provide services to you.

5. Credit reporting information

In the course of arranging or managing credit we may collect from, and disclose to, credit reporting bodies (CRBs) — including Equifax, illion and Experian — credit information about you including identification details, credit type and amount, repayment history information (for eligible credit), defaults of 60+ days for amounts over $150, serious credit infringements, court and insolvency information.

CRBs may include your information in reports provided to other credit providers to assist them to assess your creditworthiness. You may request a CRB not use your credit reporting information for pre-screening of direct marketing, or in circumstances of actual or suspected fraud. Contact details for each CRB are on their websites.

6. Who we disclose your information to

  • The Australian Credit Licence holder (Connective Credit Services Pty Ltd, ACL 389328) and its aggregator systems.
  • Lenders, funders, private credit investors, warehouse counterparties and mortgage managers.
  • Credit reporting bodies, valuers, insurers, mortgage insurers, solicitors, conveyancers, accountants and settlement agents.
  • Brokers or referrers who introduced your deal (only for the purpose of that deal).
  • Our IT, hosting, CRM, analytics, communications, email delivery, database and infrastructure providers.
  • Regulators including ASIC, AUSTRAC, the ATO, the OAIC, AFCA and law enforcement, where required or authorised by law.
  • Any party to whom we assign, novate or transfer our rights or business.

7. Overseas disclosure

Some of our service providers (including cloud hosting, email delivery, analytics and AI providers) may store or process personal information in servers located outside Australia, including the United States and the European Union. We take reasonable steps to ensure overseas recipients handle your information consistently with the APPs.

8. Marketing

We may use your contact details to send you information about our products, services, market updates and events. You can opt out at any time by using the unsubscribe link in any email or by emailing us at the address below. We do not sell personal information to third parties for marketing.

9. Cookies and analytics

Our website uses cookies and similar technologies to operate the site, remember preferences, measure performance and, where enabled, support advertising. You can control cookies through your browser settings. Blocking cookies may affect site functionality.

10. Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure, including access controls, encryption in transit, secure hosting and staff training. We retain personal information for as long as required to provide our services and to comply with our legal obligations (including a minimum of seven years under the AML/CTF Act and NCCP record-keeping obligations), after which we securely destroy or de-identify it.

11. Accessing and correcting your information

You can request access to, or correction of, your personal information at any time by contacting our Privacy Officer using the details below. We will respond within a reasonable period and, generally, without charge. Where we refuse a request we will provide our reasons in writing.

12. Complaints

If you believe we have breached the APPs, the CR Code, or otherwise mishandled your personal or credit information, please contact our Privacy Officer. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days. If you are not satisfied with our response you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or, for credit-related complaints, to the Australian Financial Complaints Authority (AFCA) at afca.org.au (our AFCA membership number is 121182).
